The great challenge in this (complaint matters) matter is to substantiate the allegations without access to official records. Fortunately publicly available court records of Administrative Appeals Tribunal hearings allow me to do that. Whilst the Repatriation Commission is the primary target, examination of these records seems likely (appear) to show that the AAT in a significant number of cases also incorrectly applies the case law. It follows that there is a high probability that the Veterans Review Board and the Repatriation Commission (DVA) have similarly erred. Naturally the number of incorrectly decided cases will be larger as we move back down the chain of decision (or review). This compounds a very great travesty of justice. The very bodies that are supposed (charged) to provide an independent review of cases are using the same rules that (as) the Repatriation Commission is using. The Repatriation Commissions expertise (experience) in these (complaint) matters is that it has been to the High Court on five occasions and lost on all five occasions. Not prepared to accept the umpires decision the Repatriation Commission normally tries to have the rules changed by amending legislation. When this hasnt worked it seems to have made a deliberate decision to not apply critical aspects of the court determinations. I have included copies of relevant documents. An essential part of democracy is the legal system. An essential part of the legal system is the Doctrine of the Separation of Powers. The Doctrine of the Separation of Powers is being circumvented. The Chief Justice of the High Court is a person of the highest integrity. Questions concerning contempt of the High Court can only be resolved by the High Court. Contempt proceedings could be initiated by the High Court. The powers of the High Court are legislated and if they need to be changed to accomplish these matters the legislation can be changed. Enquiries or commissions convened by the government of the day (either major party) will be manipulated AAT Court Records.
